10.23.09 Your seller has a tenant in the home he wants you to list. The tenant has stopped paying the rent. When you call to see the home so you can list it, the tenant makes all kinds of excuses

about why you can't come and see the home.

How do you handle this?

Call your client and tell them what is going on. It is not our job to make decisions for our clients - present the situation and find out what they want to do.

[but do it quickly because I want you to list the house so I can still dk in the area and have some open houses! : )]

Notice of intent to sell in writing is to be given immediately to the tenant....(that's the key)...Thereafter, the tenant, in accordance of the notice to sell in writing, is it written, that the tenant shall make the Premises available with 24 hour notice verbal or in writing to the Landlord or the Landlords representative (that be me) for the purpose of entering to show Premises to prospective or actual purchases, period...No permission or prearrangement with the Tenant is nessecary or need be given...it already has been given in the form of the written or verbal notice...it's beautiful...I simply get the key from the Landlord and show it. However if/when the tenant first shows any form of uncooperativeness to the first notice written or verbal, the Landlord's representative (that be me) may then bring the issue to the Landlord's attention to perform a second 24 hour notice to show and arrive with the Landlord present to gain access with the Landlord. The fact that the Tenant is in the rears with rent is an issue between the Landlord and the Tenant and there are the appropriate measures the Landlord can and should take to gain rent and/or evict. It is likely the Landlord has an agent who secured the Tenant and can then coordinate these procedures accordingly with that agent and in accordance with the contract between the Landlord/Tenant. Having experience in this matter I can say that it depends on the temperament of the Tenant and overall condition of the home the tenant leaves the place that I determined we could move forward with a formal public listing till tenant is evicted to then ready the home in Showcase condition or move forward as is...dicey...in my case there was ultimate compliance cause we just did it in accordance to the contarct...what can they say when you take any chance to argue away...I love it

Agent: I would print out what Yancy said and confirm this with my office manager and then go and do likewise!

Check out C.A.R. Form LR Revised 11/08 (Residential Lease or Month-to-Month Rental Agreement), line 19. Entry: A. and B. I had this happen with a listing taken in 07. Took the situation to my manager who immediately swung around in her chair to her computer, went to www.car.org, pulled up the lease contract and we studied it and worked it out from there, in the black. So, from then on was the lesson learned, it's all in the contract, that why we have'm...next best thing to being a Lawyer, without law school...I love it

I "ditto" Yancy's reply-- check with C.A.R and see what form is available- I am pretty sure there is a boiler plate for tenants like these.

I would go to the owner and tell him about his tenant.s uncooperativeness. Let the owner deal with the tenant. I would advise him to speak to an eviction attorney and discuss his options in this matter.

Yancy, you're right, but it just won't help. An uncooperative tenant will destroy the sale, while still following the law.

Mr. Seller, you've got a real problem that is going to cost you a lot of money. (explain all the ways a tenant can make your life a living nightmare).

You have 2 choices- either evict the tenant and then sell the house or bribe the tenant with money to gain cooperation. Just make sure the money isn't paid until the cooperation is rendered!!
